Appeals
If you have been convicted and sentenced for an offence, or a number offences, the law allows you to appeal to the decision. McGirr & Associates has extensive experience in running appeals in the District Court and Court of Criminal Appeal and can provide you expert advice on the nature of the process and the chances of success. Call Paul FC McGirr on 0405 508 099 for more information.
It is important to note that there is not always an automatic right of appeal and it may be necessary to obtain leave from the appropriate court. This may also mean complying with time limits that are in place to lodge the appeal. Even if you are out of time, you may still apply for leave to appeal and the court may elect to grant leave if it accepts your reasons for delay.
Generally speaking, you may elect to appeal the conviction, the severity of the sentence or both. Appeals will often require a detailed analysis of the case law, the applicable legislation and, in some cases with the leave of the court, further evidence. This is why you should contact McGirr & Associates so as to ensure your appeal is prepared diligently and effectively presented in court.
